Soar Performance Group Pty Ltd, trading as Lotus Legal, and its controlled entities (Lotus Legal/the Company) is committed to ensuring the privacy of the personal information provided by clients to the Company.
Lotus Legal is subject to the Australian Privacy Principles (APP) pursuant to the Australian Privacy Act 1988 (Cth) (the Privacy Act), and therefore, we understand the importance of your personal information, and how we use or protect it, which we set out in this privacy policy (the Policy).
Personal Information Collected
Personal information includes information such as names, date of birth, contact details, addresses, photographs, or various licence and registration numbers such as driver’s licence and passport.
Throughout the course of your dealings with Lotus Legal, you may voluntarily offer personal information to us, including through the Company’s website when you make an initial contact enquiry, or through other correspondence, documents or forms which will allow us to assist you with your matter.
We may also collect sensitive information, including, but not limited to information such as health information and ethnic origin depending on your matter.
Personal information will only be collected where it is reasonably necessary for us to provide legal services and with your consent (usually by a client/retainer agreement) or other written correspondence.
Finally, there may be limited instances in which you are required to provide personal information about third parties to Lotus Legal or where your information is provided to us by a third party. In those situations, the Company will protect that information as set out in this Policy, however, we are also relying on you to confirm that you have received the third party’s consent to provide that information to us.
Purpose of Collection
Lotus Legal will only use your personal information for the purpose, or purposes, for which you have provided that information, as permitted by this Policy, or otherwise consistent with the Privacy Act.
We do not collect any personal information that are not necessary for the completion of your matter.
We will not disclose your personal information to third parties unless you have provided consent to such disclosure or where that disclosure is required by law.
We will also collect, hold, and use your personal information as reasonably necessary for the purposes of, or related to:
- contacting and communicating with you;
- assessing whether we have a conflict of interest with another individual or group;
- providing legal services and advice including invoicing;
- sending promotional information such as marketing material and newsletters;
- making offers of employment or for employment purposes;
- compliance with our legal obligations; and
- other similar purposes related to our business.
Access to Personal Information
Should you wish to request access to your personal information held by Lotus Legal, we require that you request this information in writing, as provided in the ‘Contact Us’ section below.
We will then endeavour to respond to your request and provide you with the requested information as soon as reasonably practicable.
Lotus Legal reserves the right to charge you a reasonable administrative fee for providing you with the information requested.
If you believe that the personal information that we have recorded is inaccurate or out of date, you may request in writing that we update our records as provided in the ‘Contact Us’ section below.
Security
Lotus Legal is committed to ensuring the security of any personal information that you may provide. We endeavour to take all reasonable precautions to protect that personal information from misuse, loss, unauthorised access, unauthorised modification, and unauthorised disclosure.
The Company maintains a high level of physical and electronic security such as barrier systems, computer and network security.
However, the internet and the sending of emails by you may not necessarily be a secure environment. If you use the internet to send Lotus Legal any personal information, including your email addresses, then you accept that the information is sent at your own risk.
Lotus Legal may update its Policy from time to time, which will be available on the Company’s website.
